Action for surrender of profits by Spiess-Hegglin against Ringier

Zug Cantonal Court of Appeal partially upholds Ringier's appeal against first-instance judgment.

The Zug Cantonal Court of Appeal has partially upheld Ringier’s appeal against the first-instance decision in the proceedings concerning the surrender of profits,  reducing the amount to be surrendered by more than half. Furthermore, the order for Ringier to pay compensation for legal fees to the claimant was overturned.

Ringier welcomes this ruling. It confirms our central position: The surrender of profits demanded by the plaintiff was disproportionate to the economic reality.

The profit calculated by the Court of Appeal is – although reduced by 70% compared to the amount claimed in the lawsuit – still significantly higher than the profit actually generated, as Ringier demonstrated in its legal submissions and with expert opinions.

Ringier will decide on an appeal to the Swiss Federal Supreme Court after a thorough analysis of the decision.
